Apple Fights Back: Appeals US Ban on Apple Watch Ultra 2 and Series 9

Hey there, my fellow tech enthusiasts! It’s your favorite funny guy who loves all things technology, Nuked, here to bring you some exciting news from the world of Apple. Brace yourselves, because Apple is not taking a ban on their beloved Apple Watch Ultra 2 and Series 9 lying down!

According to court records, Apple has filed an appeal to the International Trade Commission (ITC) after their recent decision to ban the sale of Watch Series 9 and Watch Ultra 2 models in the United States. But that’s not all – Apple is also requesting an emergency stay on the ban for at least two weeks. Why, you ask? Well, they want to buy some time until they can introduce redesigned versions of these banned models.

In a statement to Reuters, Apple expressed their strong disagreement with the USITC decision and the resulting exclusion order. They are determined to do whatever it takes to get the Apple Watch Series 9 and Apple Watch Ultra 2 back into the hands of their customers in the U.S. as soon as possible. However, they did not immediately respond to The Verge’s request for comment. The suspense is killing us!

So, why were these popular models banned in the first place? Well, it turns out that the ITC found that Apple had infringed on a blood oxygen saturation technology patent owned by a health tech firm called Masimo. Oops! Apple’s attorneys are not happy about this ban and argue that the $3 trillion company “will suffer irreparable harm” if these models remain off the shelves during legal proceedings.

According to Apple’s filing, there is hope on the horizon. The Exclusion Order Enforcement Branch of U.S. Customs and Border Protection is set to make a decision on the redesigned versions of these Watch models on January 13, 2023. In the meantime, Apple is urging the court to grant a stay long enough for Customs to make this decision. Fingers crossed!
