OpenAI Lawyers Question Meta’s Role in Elon Musk’s $97 Billion Takeover Bid

Lawyers for OpenAI revealed that they subpoenaed Meta back in June, seeking documents about its potential involvement in Musk’s unsolicited $97 billion bid to take over OpenAI. The filing doesn’t clarify whether Meta has such documents.

In response, Musk’s team denied that their bid was backed by Meta, and OpenAI’s lawyers found evidence that Musk communicated with Meta’s CEO Mark Zuckerberg about xAI’s bid, possibly discussing financing or investments.

Meta objected to the initial subpoena, and now OpenAI’s legal team seeks a court order to obtain relevant evidence. They also request any of Meta’s documents related to possible restructuring or recapitalization of OpenAI, which is a core issue in Musk’s lawsuit.

Meta spokesperson Andy Stone pointed out that neither Zuckerberg nor Meta signed Musk’s letter of intent to acquire ChatGPT, and Meta declined to comment further. Neither OpenAI nor Musk’s legal team responded immediately to requests for comment.

Amid this legal drama, Meta has been heavily investing in AI, including a reported $14 billion into Scale AI and attempts to develop advanced AI models to surpass OpenAI’s GPT-4. By early 2025, Meta’s models lagged behind industry standards, allegedly frustrating Zuckerberg.

In the background, Musk and Zuckerberg’s relationship has been tense and comical, with Musk once proposing a cage match two years ago, though the AI race seems to have brought them closer in recent months.
