Recently, a judge has put a stop to the FTC’s probe into Media Matters, a well-known advocacy group. Back in 2023, Media Matters researched and revealed that big companies’ ads appeared alongside offensive content on Elon Musk’s platform, X.
After these revelations, some major advertisers reduced their presence on X, which led to legal actions. X sued Media Matters along with some advertisers, claiming they were part of an illegal boycott. However, Judge Sparkle L. Sooknanan, appointed by President Biden, decided to halt the investigation, ruling that Media Matters’ activities are protected under the First Amendment. She warned that government retaliation against protected speech should alarm all Americans and emphasized that the investigation seemed retaliatory.
The judge also pointed out that FTC Chair Andrew Ferguson had previously expressed anti-media sentiments and had staffed the agency with individuals holding similar views. The FTC hasn’t decided yet whether to appeal this ruling, but the decision marks a significant win for free speech advocates.
Even with this legal victory, the targeted organizations faced real consequences. Media Matters, for example, had to lay off staff, and other groups halted key programs due to the legal pressures.
