At the Colossus site in Memphis, the xAI data center has been accused of running up to 35 gas turbines, emitting pollutants, all without the required permits. The Southern Environmental Law Center (SELC) sent a warning letter to xAI, citing violations of the Clean Air Act, which mandates permits for such emissions.

The turbines, which can produce over 2,000 tons of NOx annually, contribute to smog and worsen air quality. Memphis already struggles with some of the worst air health stats in the nation, especially for asthma sufferers. SELC claims xAI didn’t obtain the necessary permits and failed to implement pollution controls, even though at one point, they operated turbines capable of generating 421 megawatts.

Recent inspections, including aerial and thermal imaging, revealed that most turbines remained operational after supposed removal efforts. Local authorities, including the Shelby County Health Department, have indicated that some turbines might be exempt from permits, but the legality of this remains questionable. Meanwhile, the turbines’ capacity hovered just below 410 megawatts, close to prior figures.
